1. The Contract
    1. These Terms and Conditions (the Conditions) including the information set out overleaf sets out the basis upon which we will hire certain equipment (as detailed overleaf) (the Equipment) to you. References to Hire Period mean the start date/time and end date/time period set out overleaf.
    2. If you are hiring Equipment for you and other people then you confirm that you have explained and they have agreed to be bound by these Conditions. You agree that you are liable for any breach of these Conditions by them. Any references to “you” in these terms includes any person using the Equipment.
  1. Equipment and Hire Period
    1. We will use our reasonable efforts to maintain and safety check the Equipment prior to delivery to you.
    2. You must follow any advice in any documentation we supply to you. We have no liability for any injury or damage to property that results from you not following such advice.
    3. Before using the Equipment you must conduct a basic check of the Equipment. Equipment is not supplied with spares or repair kits. You must not attempt to repair any Equipment or use the Equipment if there are any noticeable issues but should alert us to this immediately.
    4. The Hire Period is as stated overleaf.
    5. In certain circumstances we may be able to change or extend the Hire Period. This may result in additional charges. Please contact us on the telephone or email set out overleaf.
    6. You confirm that you must be 18 or over to hire/use any of our Equipment. Any use by someone under the age of 18 is, to the fullest extent permitted by law, entirely at your risk.
  1. Your Responsibilities
    1. You:
  1. will use the Equipment safely and correctly and in accordance with all applicable rules, legislation and standards including the Highway Code, Electric Bike legislation and any boat and waterway laws;
  2. confirm that you are competent and suitably physically fit to use the Equipment;
  3. acknowledge that any equipment carries inherent risks including but not limited to those posed by traffic, cyclists, pedestrians, swimmers, rocks, boats, weather conditions, risk of physical strain and tide. By continuing to hire You accept all risks associated with the Equipment and that Our liability will be limited in accordance with clause 9.
    1. Save in respect of the Accidental Damage Waiver (if any), we do not provide any form of insurance and it is therefore Your responsibility to ensure that You and anyone else in Your party are covered by suitable insurance.
    2. Where a license is required, it is Your responsibility to ensure that you meet all applicable licensing requirements and You must as part of the registration, provide Us with accurate evidence of this licensing in accordance with Our registration procedure.
    3. You are responsible for adapting to your external circumstances and determining your general ability, medical condition, weather conditions and/or any other factors or circumstances which may cause a risk to You, Your use of the Equipment or anyone else in Your party.
  1. Fees and Payment
    1. The fees for the Equipment will be as shown overleaf.
    2. The security deposit, if any, set out overleaf shall be paid by credit or debit card in advance of us delivering the Equipment or you collecting it from us. This will be used to offset against any non-return, loss, theft or damage of the Equipment. We will not release any Equipment to You without the payment of the Security Deposit. We will return the security deposit (less any sum payable pursuant to this paragraph) to you within 72 hours of us collecting the equipment.
    3. All our Prices are inclusive of VAT.
  1. Cancellation
    1. If You make a booking in advance, You may cancel Your booking at any time before the start of the Hire Period subject to the following:
    2. If the Order is cancelled then a cancellation charge will be payable in accordance with the details set out overleaf.
    3. We shall be entitled to cancel our agreement with you at any time. We will endeavour to give you reasonable notice. In the event of cancellation then our total liability to you will be to return any fees already paid.
  1. Collection, Hire and Return
    1. The Hire Period begins and ends on the date and times stated overleaf.
    2. You should check Equipment at the time of collection. If there are any parts missing or if there is any visible damage to the Equipment, You should inform Us immediately. Provided that you notify us promptly, we will use our reasonable endeavours to replace missing or damaged Equipment. If We are unable to replace missing parts or damaged Equipment and the Equipment is not fit for safe use, You will receive a refund of any sums paid to Us in respect of such equipment. We will pay the refund as soon as possible but in any event within 14 days.
    3. Where we are delivering or collecting the Equipment to or from you then you will ensure that you are available or return or collect the same at the agreed time. Details of the collection and return address are set out overleaf. We will provide you with approximate times for delivery and/or collection.
  1. Accidental Damage Waiver
    1. An Accidental Damage Waiver can be added to Your hire at Your request and our agreement.
    2. The Accidental Damage Waiver covers any accidental damage to Equipment while they are in Your possession.
    3. The Accidental Damage Waiver does not cover the following:
  1. malicious or deliberate damage or that which, in Our opinion, has been caused by carelessness or improper use;
  2. loss or theft; or
  3. failure to return Equipment by the end of the Hire Period.
  1. Loss and Damage
    1. Subject to paragraph 7, You are responsible for, and will be required to fully compensate Us for, any loss or damage which may occur to Equipment.
    2. Any charges due under this paragraph 8 will firstly be taken out of any Security Deposit. If the cost of repairing the damage or replacing the Equipment is, in Our opinion higher than the sum of the Security Deposit, You will be required to pay any excess sum. We shall be entitled to charge such sum against any credit card or debit card we have on file.
    3. You will not be responsible for any pre-existing damage Equipment that has already been identified overleaf.
  1. Our liability
    1. Subject to paragraph 9.2, Our total liability under these Terms and Conditions shall be limited to the total Price paid by You.
    2. Nothing in these Terms and Conditions seek to exclude or limit Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); or for anything that we cannot limit by law.
    3. Nothing in these Terms and Conditions seeks to exclude or limit Our liability with respect to Your legal rights as a consumer.  For more information on your legal rights and on the remedies you may be entitled to if something goes wrong, please contact us so, alternatively, please contact Citizens Advice Bureau.
  1. Governing Law and Jurisdiction
These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction, governed by and construed in accordance with the law of England and Wales.
  1. Consumer protection
As a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in these Conditions takes away or reduces your rights as a consumer to rely on those provisions.
